交流站/天下事 中国应警惕“叙利亚式”后遗症 宋杰 1830 words 11 February 2012 联合早报 (简体) LIAZAO 24 Chinese – Simplified (c) 2012 Singapore Press Holdings Limited   叙利亚显然是一个不好的“先例”。一旦因为中国否决的缘故而真的 导致美国等国采取“游离于”联合国集体安全机制的行动,一方面并 不利于中国利益的维护,会导致中国遭到在道义上的责难及被孤立, 另一方面也将导致事实上鼓励单边行动的结果,而这样一个结果对于 “固守”集体安全机制的中国来说,显然是一个“事与愿违”的、“ 意想不到”的结果。 自中国与俄罗斯于4日否决了美国、欧洲及有关阿拉伯国家支持的叙 利亚问题新决议案之后,一方面,全球舆论一夜之间似乎都站到了中 国与俄罗斯的对立面,纷纷谴责中国和俄罗斯为了“一己私利”而置 国际责任和国际道义于不顾,另一方面,美国等国在强烈表达自己对 中国与俄罗斯不满的同时,还正酝酿在“联合国框架外”干预叙利亚 的可能性和途径。法国总统萨科齐于5日宣称,将迅速牵头组建“叙利 亚人民朋友联络小组”。他表示,法国政府已开始与欧洲各国及阿盟 磋商,以便成立叙利亚联络小组寻找解决目前局势的可能途径。美国 国务卿希拉里·克林顿(希拉莉)5日也表示,美国与欧洲将就叙利 亚问题的“下一步动作”进行“更加紧密的合作”。 行使否决权反而促进单边行动 笔者认为,为维护自身利益及“事务本来的是非曲直”,中国固 然有权在安理会行使否决权,但是,当中国决意行使否决权的时候, 可能有必要特别考虑到如下问题:中国一旦决定行使否决权,是否会 将英美等国推到联合国集体安全机制之外,会“适得其反”地“推动 ”英美在联合国框架之外采取单独行动,从而在实质上达到了鼓励国 家或国际集团“单边行动”的结果。 作者是浙江工商大学法学院副教授,英国剑桥大学劳特派特国际法研究中心访问学者。 For full article, click here.
